Attorneys


Attorneys are in a unique position regarding the safeguarding and authentication of information entrusted to their care. The loss of information, the publication of information that was required to be kept private/confidential or the corruption of databases due to the lack of a program being in place as required by state and federal laws  can be a career ending and in some cases a license ending event.

New state and federal laws and regulations are being enacted at a dizzying rate. Forty four states at this point have rules requiring attorneys and others who possess Personally Identifiable Information (PII) and Non Public Information (NPI) to notify victims if the information is lost, stolen, misused, or accessed by unauthorized individuals. There are new National Breach Notification requirements coming into play as well. Some of them require the notification of media. It takes no imagination to fathom the consequences to an attorney who has violated state or federal law and then is required to notify all affected that their information has been lost, stolen or misused.

The good news is that doing what is required by the vast majority of statutes is neither expensive nor practice disrupting. It requires some training (online in our case) and documentation (we provide the templates). 

Unfortunately, a thief breaking into a law office for information or computers, the loss or theft of a laptop, PDA Phone, backup tape or USB key with sensitive information can cause a crisis situation. It simply is not worth the trouble when putting reasonable safeguards in place is inexpensive and non disruptive to your daily operations.
